Upon receipt of a valid DMCA notice, we will promptly remove or disable access to the allegedly infringing content and notify the user responsible for posting the content.

Counter-Notification Procedure

If you believe that the material removed was misidentified or was removed by mistake, you may submit a counter-notification to our Copyright Agent with the following information:

  1. Identification of the material that has been removed or disabled and the location where it appeared before removal.
  2. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of a mistake or misidentification.
  3. Your name, mailing address, telephone number, and email address.

Upon receiving a counter-notification, we may restore the removed content within 10-14 business days unless we receive notice from the original complaining party that they have filed a legal action seeking a court order.

Repeat Infringers

FreshUpVive.com reserves the right to terminate the accounts of users who are found to be repeat infringers of copyrighted material.
